Welcome to FaceSwaply (“we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, AI photo tools, subscriptions, credits, generated outputs, and related services (the “Services”).
By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 13 years old to use the Services. By using FaceSwaply, you represent that you meet this requirement and have the legal authority to agree to these Terms.
2. Accounts
Some features require an account. You agree to provide accurate information, keep your login credentials secure, and accept responsibility for activity under your account.
Notify us if you believe your account has been accessed without permission.
3. AI Photo Tools
FaceSwaply provides AI-powered workflows such as face swap, AI headshot generation, hairstyle previews, hair color changes, image enhancement, and related photo editing tools.
AI results may vary based on source image quality, selected settings, model behavior, and service availability. We do not guarantee that every output will be accurate, realistic, suitable for a specific purpose, or free from visual artifacts. Some tools involve identifiable faces, likeness rights, and potentially sensitive personal data, so you must use them responsibly.
4. User Content, Likeness Rights, and Consent
You retain ownership of images, prompts, settings, and other content you upload, subject to any rights held by third parties.
By using the Services, you grant us a limited license to host, process, transmit, display, and store your content as needed to provide the Services, operate account history, troubleshoot issues, and maintain security.
If you choose to make content public, you grant us permission to display that public content in galleries, examples, featured cases, marketing materials, or product pages. You can change visibility or remove public content where the product supports it.
You are responsible for ensuring that you have the rights and permissions needed for any image, likeness, face, brand, artwork, or other material you upload or generate. This includes obtaining any consent, release, parental authorization, or other approval required for an identifiable person in a photo or video.
If law, platform rules, or professional standards require you to disclose that content is AI-generated or AI-edited, you are responsible for making that disclosure.
5. Acceptable Use
You agree not to use the Services to:
- Violate any law, regulation, contract, intellectual property right, privacy right, or publicity right
- Upload or generate illegal, abusive, hateful, exploitative, deceptive, or harmful content
- Impersonate someone, defame someone, mislead others, or create content that violates another person’s rights
- Upload images or videos of people without required permission where permission is legally or ethically required
- Create non-consensual face swaps, deceptive political content, fraud, impersonation scams, harassment, blackmail, or humiliating content
- Use the Services for sexual exploitation, child safety violations, stalking, doxxing, biometric surveillance, or identity verification without authorization
- Interfere with the Services, bypass security, scrape the platform, or use unauthorized automation
- Resell, sublicense, or provide access to the Services in a way we have not authorized
We may remove content, restrict usage, suspend accounts, refuse service, or cooperate with lawful requests when we believe these Terms, safety rules, or applicable law have been violated.
6. Subscriptions, Credits, and Payments
Some tools require credits or a paid subscription. Credit costs may vary by tool, model, generation type, and settings. The service may show an estimated credit cost before generation.
Subscriptions provide a recurring credit allowance or access rights based on the selected plan. Credit packs provide one-time top-ups. Credits are not cash, are not bank deposits, and cannot be transferred or resold.

7. Generated Outputs and Commercial Use
Unless otherwise stated, you may use generated outputs for personal or commercial purposes, subject to these Terms, applicable law, and any third-party rights in the materials you upload.
You are responsible for reviewing outputs before publication or business use. Do not rely on generated outputs for identity verification, legal documentation, medical purposes, financial decisions, biometric profiling, or other high-risk uses.
8. Intellectual Property
The Services, website, software, interface, branding, documentation, and underlying technology are owned by us or our licensors. You may not copy, modify, reverse engineer, distribute, sell, or create derivative works from the Services except as permitted by law or with our written permission.
9. Disclaimers
The Services are provided “as is” and “as available.” We do not guarantee uninterrupted availability, error-free operation, specific generation results, or suitability for any particular purpose.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by law, FaceSwaply and its affiliates, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities.
Our total liability for any claim related to the Services will be limited to the amount you paid to us for the Services giving rise to the claim during the three months before the claim arose, or the minimum amount allowed by applicable law if no payment was made.
11. Termination
You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms, create legal risk, misuse credits or payment systems, or harm the operation of the Services.
After termination, your right to use the Services ends. Certain provisions, including those related to ownership, payment, disclaimers, limitation of liability, and public content permissions, will survive termination.
12. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on this page with a new “Last updated” date. Continued use of the Services after changes means you accept the updated Terms.
13. Governing Law
These Terms are governed by the laws applicable to FaceSwaply’s operation, without regard to conflict of law principles, unless mandatory local law requires otherwise.
